The Constitutional Court decision dated 25/12/2024 and numbered 2024/29 E., 2024/226 K. is published in the Official Gazette dated 14/03/2025.
As per the aforementioned Constitutional Court decision;
- The provision “If each of the two parties is partially justified in the case, the court shall allocate the trial expenses according to the proportion of the parties’ justification.” in paragraph (2) of Article 326 of the Code of Civil Procedure numbered 6100 titled “Responsibility for Trial Expenses” is unconstitutional in terms of Moral Compensation Cases and ANNULLED.
The decision shall enter into force 9 (nine) months after its publication in the Official Gazette (14/03/2025).”
