
Exception of the Enrollment Obligation in the Data Controllers’ Registry for Associations, Foundations and Trade Unions
Turkish Data Protection Board (“Board”), has made amendments to the exception of the enrollment obligation in the Data Controllers’ Registry for associations, foundations and trade unions with its decision[1]. Such amendments are as follows:
- It has been stipulated that in order to be included in the scope of the exception; the associations, foundations and trade unions shall resident in Turkey.
- “Associations established under Associations Law numbered 5253, foundations established under the Foundations Law numbered 5737 and trade unions established under the Trade Unions and Collective Bargaining Agreements Law numbered 6356” and “regarding their respective employees, members, regulars and donators” clauses have been abated and therefore; such exception is limited to (i) the accordance with the relevant legislation and purposes of the legislation, (ii) the areas of activity of such associations, foundations and trade unions and (iii) being resident in Turkey.
