Suspension of Time Limits in Turkish Industrial Property Law Due to COVID-19

With Law on the Amendments to Certain Laws numbered 7226 which was published in Official Gazette number 31080 (Bis) and dated 26.03.2020, all times regarding the origination, exercise and termination of any rights, including the commencement a lawsuit, commencement an enforcement proceeding, application, complaint, objection, warning, notice, submission and statute of limitations, period of prescription and mandatory administrative application terms are suspended from 13.03.2020 until 30.04.2020. Such regulation also involves the times set forth under the Turkish Industrial Property Law numbered 6769.

Turkish Patent and Trademark Office has released information regarding how time limits transactions, which are set forth under the regulation of industrial property, to be made. Accordingly;

• Time limits of the transactions which expire on 12.03.2020 or in an earlier date, will not change.
• Time limits of the transactions which expire between 13.03.2020 and 27.03.2020 (including these dates), will be 15.05.2020.
• Time limits of the transactions which expire between 28.03.2020 and 30.04.2020 (including these dates), will be the dates to be determined by adding 49 days to such time limits.
• Time limits of the transactions which start between 13.03.2020 and 27.03.2020 (including these dates), will start on 01.05.2020.
