The 12th Family Court of Antalya applied to the Constitutional Court for the annulment of the phrase “for an indefinite period” contained in Paragraph 1 of Article 175 of the Turkish Civil Code No. 4721. By its decision dated June 4, 2026, Case No. 2025/156 E. 2026/131 K., the Constitutional Court ruled that the phrase “for an indefinite period” in Paragraph 1 of Article 175 was contrary to Articles 2, 5, and 17 of the Constitution and annulled it. The relevant Constitutional Court decision was published in the Official Gazette on September 30, 2026, and it was decided that it would enter into force nine months after its publication.

A party who will fall into poverty as a result of the divorce may, provided that their fault is not more severe, request alimony from the other party for an indefinite period, in proportion to the other party’s financial means, to support their livelihood.
